IThis catalogue in electronic format and all its contents replace all previous editions of the same catalogue that have been published and distributed in any form and for any commercial and legal purpose.
The aim of this catalogue is to allow the owner of a car to easily identify it and to find the spare part he needs to repair it.
Spare parts for French cars visible from the outside may currently not be sold in France, nor in the French overseas territories. The brands ALFA ROMEO, AUTOBIANCHI, AUDI, BMW, CITROEN, DACIA, CHRYSLER, DAIHATSU, NISSAN, CHEVROLET, FORD, FIAT, IVECO, FIAT, IVECO, HONDA, HYUNDAI, ISUZU, JEEP, JAGUAR, KIA, LANCIA, LADA, LAND ROVER, LEXUS, MITSUBISHI, MERCEDES, SMART, MERCEDES, MINI, MAZDA, OPEL, PIAGGIO, PEUGEOT, PORSCHE, ROVER, RENAULT, SAAB, SUBARU, SKODA, SEAT, SSANGYONG, SUZUKI, TALBOT, TOYOTA, VOLKSWAGEN and VOLVO used in this catalogue are owned by the manufacturers of the cars they refer to. Their use in this catalogue, as well as the original references quoted, serve only to help identify the car model the spare part is to be fitted to. Our articles, although not original, are perfectly adaptable to the cars they refer to.
The spare parts of equivalent quality produced and distributed by PRASCO S.p.A. visible during the normal use of the vehicle and intended to be mounted on French cars such as CITROEN, PEUGEOT, RENAULT, DACIA, may not be sold and/or resold by the customer, its officers and/or customers, as well as by third parties, in France as well as in all countries where the French law on industrial and intellectual property is in force.
As per the ruling of the EU Court of Justice dated 26/09/2000, the simple transit of such products, legally manufactured in a EU member state, in order to let them be marketed, equally lawfully, in another EU member state, in the French territory and/or another where the French law on industrial and intellectual property is in force, does not affect the right of the owner of any trademark, design or model, as it does not imply any illegal use of the protected right, as intra-community transit does not fall within the specific object of the industrial and commercial property right on trademarks, designs or models.
Once upon a time the original spare part (i.e., for simplification, the one produced directly by the vehicle manufacturer, or by original equipment suppliers, according to the technical specifications and production standards provided by the car manufacturer for the production of components used for the assembly of its vehicles) has always been considered to be of higher quality than that coming from non-original manufacturers.
With the application of the EC block exemption Regulation, n. 1400/2002 (also known as the Monti Law), relating to article 81, paragraph 3, of the EC Treaty (now replaced by article 101, paragraph 3 of the Treaty On The Functioning Of The European Union) about vertical agreements and concerted practices in the automotive sector, the concept of "spare parts of corresponding quality" was introduced, as defined in the article 1, paragraph 1, letter u, as those spare parts manufactured by any company that can certify, at any time, that the quality of those spare parts corresponds to that of the components used for the assembly of the vehicles in question.
Subsequently, following the expiry of Regulation no. 1400/2002 scheduled for May 31, 2010, the European Commission has introduced a new regulatory framework for the automotive sector, focused on after-market problems.
Applied on the market starting from the 1st of June 2010, these new rules are contained in the Exemption Regulation (EU) no. 461/2010 and in the related guidelines (specific on vertical restraints of agreements for the sale and repair of vehicles and the distribution of spare parts), as well as in the Exemption Regulation (EU) no. 330/2010 and in the related guidelines on vertical agreements.
These regulations, which will apply until the 31st of May 2023, concern the production and trade of spare parts, as well as the repair and maintenance of cars, light commercial vehicles and trucks.
The recital no. 20 of the guidelines to regulation no. 461/2010 contains the new definition of "spare parts of equivalent quality", or parts of whose quality is sufficiently high not to damage the reputation of the authorized networks of vehicle manufacturers.
The responsibility for proving that the spare part does not meet this condition always lies with the car manufacturer.
Therefore, as a consequence of this new definition featuring in the Monti Law, and amending the previous one, a spare part of equivalent quality cannot, in itself, be identified according to the quality of the part originally assembled, even if the same spare part of equivalent quality may be better than the original one.
